PVI Productions Hosting Service Terms and Conditions

 
 

Term of Contract

The initial term will be for 1 year from the date the Hosting Services are first provided by PVI Productions (PVI). This contract will be automatically renewed for another year at the end of the current term unless you provide PVI with written notice of termination at least 30 days before the end of your current contract.

Termination

Your hosting contract may be terminated: (1) by you within 30 days of the end of your current hosting contract as described above; (2) by PVI in the event of nonpayment or (3) by PVI, at any time, without notice, if, in our sole judgment you are in violation of any of the terms and conditions contained in this document.

Payment

You agree to pay all current charges within 15 days of receiving an invoice or statement from PVI. Failure to keep your account current may result in your Web and Email service being suspended. Should your account become seriously overdue, PVI may transfer the balance of your contract to a third party for collection. You are responsible for any costs PVI incurs in enforcing collection, including reasonable attorneys' fees, court costs and collection agency fees.

System And Network Security

For your convenience, as a PVI customer you are given access to PVI's servers for the purpose of managing your Web and email services. Attempting to use these credentials to compromise the operation or security of PVI's servers or network security is prohibited, and may result in criminal and civil liability.

PVI will investigate any incidents involving such violations and may involve law enforcement agencies if a criminal violation is suspected. Any customer found to have intentionally violated this policy will be held for the cost of labor correct any damage done to our network.

Lawful Purposes

The PVI Productions network may only be used for lawful purposes. Transmission, distribution, or storage of any information, data or material in violation of United States or state regulation or law, or by the common law, is prohibited. This includes, but is not limited to, material protected by copyright, trademark, trade secret, or other intellectual property rights.

Unsolicited Email or SPAM

Using the PVI network to distribute unsolicited bulk email or SPAM is strictly prohibited. Users can only be added to mailing lists via an opt-in function that includes  a confirmation email sent to the new subscriber, to which they must respond with a confirmation that they wish to be added to the list. In addition, each message transmitted from the list must contain instructions for subscribers to remove themselves from the list.

Violation of our SPAM policy may result in PVI restricting your access to the network to prevent further violations. If a customer is found to be in violation of our SPAM policy, PVI may at our discretion, restrict, suspend or terminate customer's account.

Inappropriate Content

The PVI network is intended for use by mainstream businesses and organizations. We reserve the right to remove content or terminate service that we deem inappropriate, including but not limited to: adult content, pornography, material endorsing hate or violence and any other content likely to incite attacks on our network resources.
